Terms of service

Tuning and hardware purchases made through our webstore, http://www.roguearttuning.com, and outside of the webstore, are to be shipped/completed at the earliest availability. If a hard product is currently in stock, it will be shipped out generally within 1-2 business days by FedEx Ground, unless otherwise requested by purchaser. If a product ordered is not currently in stock, it will be shipped out as quickly as possible, upon arrival to Rogue Art Tuning, LLC. If a purchased product is not currently in stock, but has the ability to be drop shipped, the product will be drop shipped at earliest availability. 

Once product(s) are received, it is then up to the customer to communicate those product(s) are in possession, and that they are ready to move on to Engine Management calibration work. Details about vehicle manufacturer, vehicle model, model year, fuel type(s) being calibrated, any aftermarket modifications, and often details about the hardware (example: Cobb AccessPort serial numbers, Ecutek USB Deskey ID's) must be communicated to Rogue Art Tuning, LLC, so that all the information required to perform work is available.

In addition, any work being performed requires that the vehicle in question does not have any factory emissions defeat devices, and is compliant with the emissions standards laid out by the Environmental Protection Agency. This includes, but not limited to, any exhaust modifications that remove the catalytic converter(s), deletion of an exhaust gas recirculation valve, deletion of any variable intake manifold components that are designed for emissions purposes, and removal of any evaporative emissions system components.

If it is to be discovered at any point, that any vehicle being calibrated by Rogue Art Tuning, LLC, remotely or in-person, is not compliant with the  emissions regulations created by the United States EPA, any calibration work in progress is subject to, and most likely will be terminated immediately and will not qualify for any product refunds. If a vehicle is found to be non-compliant, with services terminated, it is possible to resume work, after the vehicle has been made compliant, and any emissions defeat devices have been removed, and replaced with the components from original vehicle manufacturer. Resuming work after termination, with mechanical correction, is possible, but subject to review by Rogue Art Tuning, LLC, and will be judged on a case-by-case basis. 

While we are not subject to California Air Resources Board (CARB) regulations at our location in Casselberry, Florida, we do require that any calibrations being performed remotely in the State of California, are compliant with any CARB emissions standards. This means, any remote work being performed in California, must have the vehicle's original catalytic converter(s) from the manufacturer, as well as any exhaust gas recirculation valves, variable intake manifold components, evaporative emissions components, etc. Any aftermarket modifications done to a vehicle residing in the State of California, must be with CARB certified products only. Any changes to mechanical components that are not CARB certified, are considered non-compliant with the regulations of CARB, rendering Rogue Art Tuning, LLC, unable to perform any calibration work. If it is to be discovered that an Engine Management calibration in process in the State of California is not compliant with CARB regulations, any further calibration work is subject to, and will likely be terminated immediately. There will not be any product refunds issued under these certain circumstances.

If the calibration process is terminated due to vehicle not being CARB compliant, correction of any non-compliant components is subject to review by Rogue Art Tuning, LLC on a case-by-case basis for continuing any work after repairs.

Any calibration work being performed remotely, requires that the customer obey all their local rules of the road, while performing any engine parameter datalogging, or gathering any information related to the calibration process. Customers will receive specific instructions during the remote tuning process via email, laying out what kind of driving needs to be done for any/all datalogging procedures, as well as what Engine Management parameters need to recorded. It is highly recommended that any datalogging performed, is done in a safe environment, generally on lightly traveled roads, during the daytime, away from other motorists and pedestrians. Rogue Art Tuning, LLC requires that customers do not put themselves, other motorists, or pedestrians in danger during the datalogging and tuning process. Keeping oneself, and any bystanders safe from any harm during the calibration process is a must, and if any reckless driving during the tuning process that could put oneself, and/or others in danger will not be tolerated, and is subject to termination of the calibration process immediately. 

The Engine Management calibration process for vehicles, will likely put the vehicle under conditions that are much more strenuous than typical daily driving conditions. The calibrated vehicle will likely see many high load, high RPM conditions, which can cause premature wear of mechanical parts, and even major mechanical failures. It is up to the customer to ensure that their vehicle is in safe and fully-functional condition. This includes, but not limited to, running correct fluids at proper levels and maintaining manufacturer recommended service intervals for fluids and other maintenance parts, ensuring the vehicle has no leaks, fluid or airflow based, safe and fully functional suspension components, proper size wheels/tires, without excessive treadwear, and fully functional brake components. 

It is the customer's own responsibility to ensure their vehicle is properly maintained, and that quality parts, fluids, and fuels are used at all times. The calibration process can be hard on mechanical components, which have limitations on amount of wear, and capable load, and can fail from stress, regardless of the actual Engine Management calibration. For this reason, Rogue Art Tuning, LLC, is not liable for any damages occurring during, or after the tuning process.
